SRINAGAR – After directing CIK wing of the J&K Police to prove its validity in the eye of law, second Additional Munsiff/Judicial Magistrate M. I. Masoodi, will hear the arguments in the case on the 5th November.
Advocate G.N Shaheen told KNS that CIK produced two accused namely Mohammad Ahsan Dar and Nisar Ahmad Bhat in the case under FIR number 10/2010 in the court with the pray of their remand.
Shaheen and Advocate Babar Qadri pleaded before the court as defense council that the CIK was established in 1971 for six months and no order has been issued to validate its existence in the eye of law, adding Court cannot give an accused person in remand to the illegal agency.
Shaheen told KNS that under the provisions of law an accused cannot be given remand to an illegal agency. He said that the matter involves Question of Law.
Meanwhile, the court has directed the CIK to prove its validity in the eye of law in next hearing, said Advocate Babar Qadri.
Pertinently, the Defense council also argued that the accused persons had been behind the bars when the FIR was lodged against them in 2010. (KNS)
